NY police say they're building a rape case against Harvey Weinstein

04 November 2017

The New York City Police Department said Friday that a 2010 rape accusation against Harvey Weinstein is "credible" and the Hollywood mogul would have faced immediate arrest if he were now in the state and the incident was more recent.

The NYPD is investigating a third sexual assault allegation against Harvey Weinstein - this time from an actress who accuses the fallen movie mogul of raping her in 2010, authorities said.

The Manhattan district attorney's office has a senior prosecutor assigned to investigate de la Huerta's rape claims, AP reported. This happened seven years ago, and we found corroboration along the way.

De la Huerta has appeared in several movies and in HBO's Boardwalk Empire.

She joins dozens of women who have already leveled allegations of sexual abuse against Weinstein.

The Associated Press does not typically identify people who say they are victims of sexual assault unless they speak publicly, which de la Huerta and Guiterrez have done.

Boyce said that De le Huerta's story was credible partly because of her "ability to articulate each and every minute of the crime, where she was, where they met, where this happened and what he did".

"As this is an active investigation", the statement continues, "we will not be commenting further".

Weinstein allegedly offered a ride home to her apartment where he demanded to come inside and have a drink de la Huerta said.

In Los Angeles, Officer Drake Madison, spokesperson for the Los Angeles Police Department, told USA TODAY the department now has two open investigations on Weinstein.

Vance's office declined to bring criminal charges against Weinstein in 2015, after Weinstein admitted in a recorded conversation he groped model Ambra Battilana Gutierrez. NY doesn't have a statute of limitations on rape.

He said the NYPD was working on the case with the Manhattan district attorney's office. The "Walk To Remember" actress was 26 when she met Weinstein at a hotel in NY and he later demanded to go back to her apartment. Reportedly $600,000 raised would be given to the American Repertory Theater (A.R.T), a venue that had housed a trial run of the Weinstein-produced Finding Neverland.
